  • Change of Status from L1-B to L1-A

    Hi,

Can any body help me regarding below questions.

My L1-B Visa was approved in May 2008 and I came USA in Dec on L1-B. My L1-B’s first 3 years will be completed by May 2010.

When my employer applied for my L1-B, they have applied under Specialized Knowledge category. Right now I got the Promotion and my position is Production Manager here now and I am managing 8 people in our company. But, My salary is very less ($50,000 per annum).

Now I heard that, I can change my L1-B to L1-A. and I asked my employer about it and they agreed to do the COS from L1-B to L1-A. And also they agreed to process my GC.

    1. Instead of applying for L1-B extension, Can I apply for COS from L1-B to L1-A?
    2. How many months before I need to apply?
    3. Filing fee is around $300+ and How much it will be the Lawyers fee?
    4. How many days it will take to get approved?
    5. What type of queries we may get from USCIS?
    6. What type of problems we may need to face?
    7. If COS denied by USCIS, will they give the extension for L1-B at the same time.
    8. If COS approved, do I need to apply as L1-A to get L2’s(I-94) for dependants.
    9. After approval of COS from L1-B to L1-A, If I go to my Home Country, Do I need to attend the US Consulate?
    10. After getting L1-A, Is there any wait time between L1-A and applying for GC?
    11. To which category L1-A holder will come to apply GC?
    12. What are the Applications do we need to fill for GC?
    13. How much time it will take to get the GC for L1-A holders?
    14. While GC was pending, what are the required things we may need, if we go to our Home Country.

    Please help me regarding this.

    Thank very much.

Answering as you have been asking repeatedly. You have to do some homework on immihelp and the forums as most questions are basic and generic.

        1. Yes. COS may not be the right word to use but possible. You cannot, company has to.
        2. Anytime before 6 months of I94 expiry.
        3. Depends on the lawyer chosen and the complexity of the case.
        4. 2-6 months in most cases. Can be PPd for $1000 extra to get the result in 2-3 weeks.
        5. Nothing to predict here. To actually show your organization structure that qualifies for L1A, revenues, supervisorial duties/proof etc.
        6. Very generic question.
        7. No
        8. L2 extension has to be filed at the same time as your extension for them to not overstay their I-94s than wait for your approval.
        9. Yes.
        10. No
        11. EB1
        12. Do your research on immihelp. It is all clearly laid out.
        13. 4-8 months.
        14. Again, very generic. Read about Advance Parole and exceptions on immihelp.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
