  • max-out date - is it linked to the visa?

    Hi everyone,

I entered US in Jul 2004 on L1-B. Visa expired in Feb 2005 and I-94 in Feb 2007. Got an I-94 extension and continued leagal status. In Jun 2008 went to Canda and got a new visa stamping which expires in Jul 2009. I-94 valid until Jun 2011. Should I calculate my max-out date from the date of first entry on first visa which is Jul 2004 or date-of entry into US on
2nd visa which is Jun 2008?

your response will be greatly appreciated.

    Thank you.

You should count all days inside the US on the status held for the total period of stay.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
