  • Stay in US during transfer from H1 to L2

    Hi Pals,

I am on H1b now and my project is getting over by mid of July and my employer wont be paying me. I am planning to change my status to L2 (as a dependent to my wife's L1) and my question is,

If I file for L2 (which might take 90 days for processing the visa) and being out of status (out of H1b), is it legal to stay in US saying "adjustment of status" ?

It would greatly help me to take further step. Thanks a lot!

Your COS to L2 has to be filed before you fall out of H1b status i.e before your last day on the job. Once USCIS gets it, you can continue to remain in US on a pending application. It is period of authorized stay.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
