Can I travel to US on L1 visa & continue to stay after resigning?

Hi All,

I am currently in India, have L1 visa but will be resigning from the company next month.I too have got H1B approval notice and plan to work in US on H1 from Oct 2009.

Questions:
1. Can i travel to US (now) on L1 and continue to stay after resigning(next month) on basis of approved H1B?

2. Would there by any 1-94 implications?

3. Is it fine to travel on L1 and write H1B while filling I-94 stamp form at airport?

4. Do i need to get H1 stamping done on passport before starting to work in US?

1. No. In what staus you plan to be between resignation and Oct 09??
2. Yes. You cannot get I-94 for H1 when you are entering using L1 visa.
3. No! of course its not ok to do that... What are you trying to do here??
4. No. You can apply for COs from within US.

You can enter only when you plan to work for your L1 employer until end of september and plan to start with H1 employer starting 01OCT09. You'll need to apply for COS so that it reached USCIS prior to that date.

This is a perfect recipe to be deported as it is fraud.
