    Hi,
    i'm having L1B visa and my wife is having an H1B visa. We both are currently working in US.
    I would like to apply for L2 for my wife as she is planning to quit.

    Please clarify the following points
    1) Can i apply an L2 for her or only my employer can apply?
    2) Does she need to travel back to india for applying her visa or can it be applied from here itself?
    3) What is the normal duration and procedures for getting an L2?

    1. You can apply.
    2. For a visa, home country or a third country. But the status can be changed with-in US by applying form I539 with the required documents.
    3. 2 ways. Go get a visa stamp and travel back on L2 or apply for a COS, wait for 2-4 months without knowing if it was approved or not. If it gets denied, then the person would be out of status if they already quit the H1b.

      Hi,
      What are the documents required along with I539?
      What would be the approximate charges?
      I'm not clear about the point 3:
      What is a COS? Can we get the visa stamped here itself? ( I thought it can be done only in my home country). How do i apply for that COS?
