  • Resign on L1B Visa

    I am having L1B visa, and staying in US for 1.5 years now. I want to resign the company and leave US in 15 days and not coming back to US for atleast 1-2 years.

    Can I resign in US itself or I need to go back to my origin country office and resing from there ?

    Will it create any probelm is relieving ? Do I get experience certificate from the company for 15 days notice period?

    Once I resign, can my company revoke the visa and ask me to travel back ASAP and not accept resignation or any other complication?

    FYI, My i-94 date is 1 years from now.

    It really depends upon your employment contract.

    You can resign while in US with courtesy notice of 2 weeks or so. But yes, there are many complications.

    1. You may have to finance for your own return ticket.
    2. Getting relieving letter and experience certificate might be difficult(depends upon HR).

    It would be best if you go back to India and resign from there with "required notice period". That way you can settle your dues if any.

    If you resign on L1B, your petition becomes invalid( as it is employer specific). So you cannot think of coming on same visa after 1-2 years. That means you required a fresh petition to come back.

    However, its your call about what to do.

      Hi

      I'm under s similar circumstance but I got a job back in India and just want to quit & go back. I got my appointment 4 years back in the Indian office and was sent to USA 2 years back for project work. Since I'm currently under USA payroll, will I be subject to the 2 weeks notice here in USA or the 2 months notice back in India?

        You have to first see the documentation you signed prior to being deputed to US. Generally companies forbid employees from resigning while on L1B, and ask them to go back to home country, serve notice period as per country of employment.
