  • L1 RFE: Urgent Help needed

    Hi,

    My current I-94 and L1 petition expired in July'09. My employer submitted my L1 extension prior to the expiration date and now my case has received a RFE from USCIS. Unfortunately, in the interim i have changed work locations from CA to GA but my employer is the same. The RFE asks questions about my previous work location (floor plans etc) and some account related queries.
    Can someone help me on these questions:

    A. In recognition of my employer's duty to deal in good faith with USCIS, i believe they plan to withdraw my case. Does this mean i need to leave the country within ten days of my case withdrawal?

    B. Can a new case for my new work location be filed for my L1 extension without me leaving the country?

    C. If not, how many days after my leaving the country, can a L1 extension/new case be filed? Does my previous case withdrawal have any influence on the decision for the fresh filing?

    1. What is the specialized skill here? It looks like your employer is using L1 to change clients and locations. If your I-94 expired, you are already illegal and have to leave the country immediately as a withdrawal makes your status from day 1 of expiry illegal. The same is true in case of a denial as well.
    2. Not possible if the I-94 expired. Read about bridging on the forum.
    3. That can be done as a CP case. The prior denial may or may not influence the decision. The overstay definitely will impact the visa as it has to be declared on the DS156 form.

      This RFE was towards a L1A extension for managerial responsibiltiies. The nature of work stays the same i.e Business Development but now focussed towards a different Client in GA instead of my previous client in CA.

      A. I searched for "Bridging" on the forum and didn't quite find detailed information on that. In context of L1A, does this mean that my employer can file another extension petition while the old case is withdrawn? If yes, can that be done without me leaving the country?

        Look at the older posts for details of bridging. If your I-94 expired, there isn't much that can be done inside the US.
