    Hi,
    This is Aftab and I work for a company A.

    1. I arrived in US on L1B Visa on 20th Jan 2006.
    2. My L1B Visa has expired on 1st Oct 2008.
    3. My I-94 is valid till Apr 2011.

    Since, My Visa expired my company applied for H1B for year 2010 which was not approved.

    Therefore, to resolve this concern my company is now applying L1A for me and I am being asked to go to Canada for stamping.

    I have few questions:
    1. What is the approval rate when you apply from Canada
    2. Since my H1 was not approved, will it have any negative impact on my L1A
    3. In case if my Visa is rejected in Canada, then do I need to go back to India directly or can I still come to US on L1A.

    Please respond and thanks in advance

    1. No one other than the consulate knows this. But home country is always recommended, more so if the qualification/experience gained was in the home country based on which you will become eligible for the visa.

    2. No, you must qualify for L1 requirements though - specialized skill etc.

    3. If your visa is expired then yes.

      Thanks for the immediate response.

      1. As per my company they do not want to send me to India as it will take atleast 1 week and my project is in critical stage. Also, my company's Head of Immigration told me that they have 100% approval rate from Canada so they do not anticipate issues.

      2. Yes, I am a manager from my company so as far as documentation are concerned we will be thorough.
      My company is a tier 1 IT company with 70,000 employees so I feel I can beleive them.

      My question is based on above answers:
      1. Do you feel If I have a fair chance to get the Visa ?
