My L1 visa is will expire on 18th Sep, 2009. My employer has not filed petition for extension so far. My question is

    1. Will it be enough, if they just file the petition so that I can stay legally?

    2. Is the receipt/ackowledgement of filing required before 18th Sep, 2009 to stay legally? Normally, how long it takes to receive this receipt nowadays?

      1. Yes
      2. Filing proof of delivery before I-94 expiry is sufficient. 1 week to get receipt.

The petition has to be approved for your legal stay to be good. If the petition gets denied, your illegal stay starts the day your I-94 expired.

ps: Operators are not standing by to assist you 24 x 7. A little patience would help as this is a volunteer forum.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
