  • Question related to Non-Immigrant Visa options?

    I have been working in USA with my employer.

    I have L-1B visa stamped on 04-NOV-2006 valid until 03-NOV-2009.

    My employer applied for H1B petition. I have H1B petition and change of status (COS) approved for the same employer.

    Notice Date: 16-JULY-2008
    Approval Notice
    Class: H1B
    Valid from 01-OCT-2008 to 01-SEPT-2011

    Note: My H1B visa is NOT stamped in my passport.

    I plan to visit India, what option I should be selecting when I apply for a Non-Immigrant Visa

    >> Are you applying for the same class of visa which is currently valid or has expired within the past 12 months? Yes or No

    You should answer NO.

    One of the line item in the visa renewal criteria states "Applicants applying for a different visa class do NOT qualify for appointments in the visa renewal category."
