  • Study Leave on L1 Visa

    I am on a L1 Visa which is valid until 2012. On the basis of this, my wife has secured the L2 Visa with EAD valid until 2012 as well.

    I am thinking of going to school by taking a study leave from my employer.
    Even though the school is full time, I am technically employed by the same employer who did my L1 although I am not entitled for pay for the period of my study.

    My wife is working right now. My question is can she continue to work on her EAD until it is valid even if I go to school in the interim ?

    Does anyone know the answer to this question ?

    If you want to study in US, you have to get F1.
    L2 is valid only if L1 guy is in status.

    When you get F1, your L1 is no more valid, and hence L2 is invalid too.

      I am not going to study in the US, I am going to study in Canada.
      Does that change anything ?

        L2 always depends on L1. No L1, no L2 too.

          My L1 is valid until 2012 and I plan to study in 2010. I wont leave my employer so my L1 would be valid. Wont it ?

            You're in valid L1 status means, you should be in US on L1. Not just when you have approved L1 petition.

            As soon as you leave US for whatever reason, you lost your status.
            All statuses are valid only when people are physically in US. Approved petitions and valid visas don't put in you status.

              The term "status" is applicable wrt immigration only when one is on US soil.
