    Hi,

    I am on L1B expiring in Aug 2010 and my husband on F1,graduating in May 2010. Then his OPT will start and he has a full time offer which he starts in July 2010. I plan to resign in March-April 2010 and immediately apply for F2.

    We have sufficient funds 2 manage ourselves wrt my salary and family funds. My questions are :

    1) After my resignation, will my L1B remain valid? Since I am no longer with the company, its like the L1B visa is also gone / cancelled / revoked. But my I-94 is stamped till Aug 2010.

    2) can I change my status in USA from L1B to F2.I dont want to be out of status at any time.

    3) If I get my receipt number, is it legal to stay in the USA even after my I-94 expires in Aug 2010.

    4) Assuming the F2 Approval comes in, the L1B is cancelled rt? Is there any way to specify the start date for F2 visa that I apply?

    Please help. I am pretty worried abt the same

    1. No, you dont hold the status of L1 after resignation. Doesn't matter what the I-94 says.
    2. Possible. You should apply for COS before you resign.
    3. Provided the COS is pending.
    4. The pending period is "period of authorized stay". Read more about that.

      Does Pending mean getting the receipt number?

      My plan was apply for F2, get the receipt number and then resign..
      People told me if i get the receipt number, I am allowed to stay until COS is approved or rejected...
      Can you please explain?

        As long as the COS application was delivered to USCIS prior to you resigning, you are fine provided the application does not have any administrative blunders like a missing signature or the wrong fees. The receipt ensures that USCIS accepted the application in the mailroom.

          One more question,

          My husbands college is in NY and I am working in Florida.
          Which service center should we use for filing for COS?
          Should it be the center based on the schools location which is Vermont or would it be from where I am working (florida) , so Texas?

          Where can i find the information? Any suggestions
