  • H1 to L1 after six years of H1

    Hi,

My six years of H1 will be completed in Jan 2010. My employer says that he will file L1 after that so that I can stay in US. Can anybody please confirm that I can continue to live in US on L1 after six years of H1 in USA?
Or I have to be out for atleast one year after my H1 gets expired?

You need to be out for 1 year unless you have filed your labor 365 days before your current H1b expiration.

Even if a labor is filed, cannot extend or change to L1 status. Employer is out of their mind.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
