    Hi

    I have a dependent L2 visa and EAD with me.
    Can anyone please tell me
    1) what's the process to apply for renewal of EAD when my both I-94 and EAD expires in Feb 2010.
    2) can I work during the renewal period of EAD.

    Same as applying for a new EAD. You need to send a photo copy of the existing EAD along with the other documents.

    2) Can I work during the renewal period of EAD.

    No. You should quit working when the existing EAD expires. You cannot work on the renewal receipt. Apply 90 days before your existing EAD expires. That way, if you don't get an approval/rejection from USCIS after 90 days, you can apply for an interim EAD card and resume working with that.

      how will the EAD renewal process work because I need to apply for I94 renewal also as both of them are expiring in Feb 2010.

        When is the L1 petition expiring? Is L1 expiring on Feb 2010 as well? If so, then both L1 and L2 extension need to be filed together first. Upon approval, EAD can be renewed.

        If the L1 petition expires on a later date, then you can extend your I-94 based on the L1 petition and the I-94 of the spouse (Form I539). Or you can leave U.S and return back on your L2 visa to get a new I-94 until the validity of the L1 petition. Then file for the EAD extension.

          My I-94, EAD and my huband I-94 all are expiring in Feb 2010.
          So we would be applying for renewal of I-94 in Feb.

          When should I apply for EAD renewal. Should i apply the same time with I-94 renewal or wait till my I-94 get extended and then apply for it?

          Actually I m working now. So i don want to loose my job. CAn i work if i have applid for EAD renewal?

            My I-94, EAD and my husband I-94 all are expiring in Feb 2010. So we would be applying for renewal of I-94 in Feb.

            Why do you want to wait till the last minute to apply for the extension? If the extension gets rejected for any given reason (Let's say it takes ~90 days for the decision to be made), then your stay past the I-94 expiry is termed as illegal presence. Apply for the extension early, get the approval and apply for the EAD extension.

            Your EAD can be extended only based on the extended petition and I-94.

              This is the latest trick being undertaken by the offshore companies. They wantingly wait till the last minute to apply for the extension so that they can continue to rake the benefits of billing on the person. Once it gets denied in 3-4 months, the person's status is not their problem. They will ask them to return to home country.

              Keep a watch on these big L1 sweatshops.
