  • Status Change from H1 to L1

Hi I came to US on L1 one year back and had a valid L1 till 2010 end.
I got H1 with COS effective date October 5 and iam working on H1 since then.
Now, iam looking for the options to go back to L1 status, will this be a valid approach?
If so, what is the procedure.
iam sure that my L1 employer is not revoked my L1 visa yet.
another issue, My H1 employer is not applied for my wife H4 yet. He will apply for H4, but i want to go back to L1.
    Plz suggest.

If your L1 employer still has a job for you, then the easiest way to get back to the L1 status is by leaving the country and returning back in the L1B visa (assuming you have a valid L1 visa. If not, you need to get it stamped).
Not a legal advice. Use of this information is strictly at your own risk.

      Thanks shervin,

Looks like bellow suggestion might works for me.
I was suspecting an issues here, plz suggest.
I already had a valid L1 visa stamped(last year), i dont have to go for visa stamping if iam planing to come back on L1. But what happens at port of entry, will they ask for my L1 employer new offer letter? and One and half month H1 pay stubs?.
I guess they(port of entry) will be aware of my status change to H1 in October09.

And i believe, my wife visa will not be a problem, if my wife is in US while iam travelling. So that she will gets her L2 status soon after iam came back to US on L1. Do you see any issues here ?

        >>>> You should be having the pay stubs from the H1B employer, right? Irrespective of whether your H1B employer had a project for you or not, they should pay you when you are in H1B. If not, you are out of status.
