  • going to canada and come back to retain status on L1

    Hi,
I am working on L1 since 2 years. this year i applied H1 through different employer and got approved.
My approval notice came on october and it is valid from Oct 16th onwards.

But I am still with my L1 employer.I want to retain my L1 status for some time and hold my H1 approval.

For this i have a suggestion that to leave the contry and come back on L1.
Is it possible to come back on L1 as my H1 status already started from Oct 16th 2009?

How many days i will have grace period to switch current job and join with H1 employer?

To leave country and come back to US on L1, I am planing to go to Canada and come back on L1. iS it advisable?

To visit canada i need canada visitor VISA. I am applying visitor VISA for canada. There i need to
specify details about my current status in US. Which status i need to mention? Is L1 or H1?

I want to mention L1 Status to canada immegration office. Is it a problem for me?

    Please help me with information.

    Thanks.

    >>>> Your employment with the L1 employer after Oct 16th till date is illegal if your H1B petition was approved with COS (with new I-94).

    >>>> Yes

    >>>> There is no such grace period.

    >>>> If your trip is too short, they won't take your current I-94 at the airport when you leave the country. The will ask you to take it with you and use the same when you re-enter. So plan correctly. Make sure you handover the L1 I-94 at the airport before leaving the country. Otherwise your trip will be of no use.
