L1 while switching company

A person has worked for company X for 6+ years. Now he is employed with company Y for 1 year. But he is joining company X back. So can company X file his L1 petition while he is serving his last few days in company Y?

L1 is intra-company transfer. If you're already working for that company, and that company has branches in US, then your company can apply for L1.

Thanks Sk4ih. But the thing is I am not working for the company but i will join the company in a week or two. In that case can i apply for L1 before i started my first day.
