    Hi,

    I worked in company A for 4 years and had an L1 visa from the same. I have switched to Company B 3 months back. Now company A is again offering me a position in US on L1 visa and the eligibility says that "The employee must have worked for branch office of your US company outside of the US for at least one year out of the last three years" which I fulfill.

    Now my question is that do I need to be an employee of company A while applying for the L1B? I mean can I keep working in Company B while Company A applies for my L1b and once approve I join Company A in US. Or I have to first join Company A again in abroad and then only they can file my L1B.

    Please help.

    L1 is for intracompany transfer. Therefore, you will have to join A again, apply for visa and then get transferred to the US.
