    My L1B visa will be expired on Aug 09 2010. I am going to my home country in the month of June on the occasion of my marriage. I will be retuning to USA on June 20 th 2010. My employer has agreed to apply my L1B (I-94) extension once I come back to USA since I will have 50 days valid visa time before my visa expiration date from June 20 2010.

    I am planning to bring my wife here along with me to USA after marriage. My question is here that Shall I go ahead and apply L2 on current petition for my wife in the month of June 2010. I am planning to book an appointment for L2 stamping in the June mid week.

    Will Immigration officers create any problems on issuing of L2 since I will have 2 months L1B visa period at that point of time. Will CBP officers ask any questions at Port Of Entry ?

    Could you please suggest me that I can go ahead and apply L2 in the month of June on current petition or not. OR Do I have to wait for new L1B extension approval. This will take some time because my employer will apply for L1B extension once I come back to USA.

    There shouldn't be any issues. She can go with your current petition. She will get a visa only for 2 months. You will need to file for extension immediately upon your return.

        Travel to India with 50 days valid visa

        Hi shervin143,

        Once again thanks for your reply, I have few queries regarding my vacation and visa extension. I have mentioned details regarding visa expiration date and vacation plan. Your previous answer replied to my questions, but I wanted to make sure that am I on correct path or not ?

        My queries are here that

        1) Does it create any issues at POE If I come back to USA without having 6 months validity of visa ?

        2)Do Immigration officers allow me to enter into USA at POE with valid 50 days visa,

          As long as the visa is valid, you can enter U.S. However, the I-94 will be issues only for the duration of the visa (or until the petition expiry date).

            US entry with 50 days valid Visa

I heard that one of my friend went to India with 2 months valid visa. He has approved petition , While coming to US , Home land security asked him to show the return ticket since his I-94 expires with in 2 months.
            My company is ready to file for my extension once I come back to US.

            Could anyone answer to my question as below.

            1) Do I need to book return ticket for safer side ?
            2) What are the possible questions Immigration officers may ask at port of entry ?

              >>> Which I-94 are yu talking about? How do you have an I-94 when you are in India. Yu are supposed to return all your I-94's when you left the country.

              >>> These things happen rarely. It depends on the officer. Usually they will advise that you will have to leave 6the county before the I-94 expires and will let you in with an I-94 until the visa/petition validity. You should be in a position to convince the officer that your company will be filing the extension immediately.

              2) What are the possible questions Immigration officers may ask at port of entry ?
              >>> Usual questions. Mostly about your work/client/employer.

                Thanks once again.


                Sorry for the confusion.. I have returned my I-94 while coming India. I should have written L1B visa in place of I-94. Anyway I got answers for my questions. I have letter from company saying that extension process will be started immediately once I am back to USA. I will take a print out of that mail and show it to the officer if they ask any return tickets details.

                  When to file L2

                  Hi All,

                  My L1 / I129 petition is in RFERR state. Now i have got married and i would like to file L2 for my spouse. When should we/my company initiate L2 request?
                  The catch is i am yet to attend the L1 interview.
                  Should we wait for my L1 getting stamped and then to apply for L2 for spouse?
                  Or can we file L2 with my Li/I129 petition receipt number?

                    If both you and your wife are outside the US, there is no such thing as L2 request. Whenever the L1 petition gets approved, both you and your spouse can apply for L1 and L2 Visas at a US consulate/embassy together or separately.
