Urgent : L1 Extension in Process, can I leave USA and come back on fresh visa stamp ?

My employer filed my L1 extension . Old Visa and I-94 expire in March 2010. I need to go out of USA on urgent family need and may not come back soon. I will return my I-94 upon leaving USA. I plan to get my passport stamped at US consulate in India based on new petition approval and then only come back to USA. Will this be a problem ? Appreciate help.

No Problem, but!

No issues. Make sure you don't stay in the US beyond the date mentioned on your existing I94. Leave before it expires. Get the visa renewal and when you come back, you will be issued a new I94 at the POE.

Didn't you get a new I94 with your L1 extension approval?
