Visa Expired before I-94
Hi Shervin,
I have L1-B Visa. My visa got expired on 30-March-2010 but I have I-94 till March 2011. I'm planning to go to India on Vacation on 12th November-2010 and planning to come back on 12-Dec-2010.
When I check with my company immigration team, they are saying that I can apply for I-94 extension 6 months before I-94 expiration. So, I can apply for I-94 only on 1st Oct 2010. I don't think I will get my petition extension approved before 12-Nov-2010 even I go with PPS.
My immigration HR is saying, I can get fresh L1-Petition approved when I visit India and comeback to US.. But they are asking me to apply for petition 1 or 1.5 months before I leave US..
1) How can they get fresh L1-Petition approved in just 45 days?
2) Can I apply for fresh L1-petition in India by staying in US? becoz they are saying I need to give India address to apply for fresh L1-Petition..How can I give India address when I staying in US? This is confusing me? Could you make to understand this process?
