F1-EAD on L2 VISA

  • F1-EAD on L2 VISA

    I am currently on F1-OPT VISA and have an EAD card. My EAD is expiring in June'10. My husband is on L1 VISA. I will be applying for a L2 VISA.

    Once I receive my L2 VISA, can I work using my current F1-EAD (till it expires) until I receive a new EAD card for L2? or do I have to wait for a new EAD card on L2 VISA?

    If you enter U.S on L2, then you cannot use F1 OPT. You will need to wait for the L2 EAD to get approved.

        Visa is only an entry document to U.S. If you are already in U.S, then you don't need a visa (You will need it only when you go out of the country and want to re-enter). All that you need to do is to apply for a COS to L2.

          Thank you for the reply. On the L2 Change of status, can I not work on my earlier EAD, until I get new EAD? Also, how much time will it take to do COS from F1 to L2?

            You can work until the COS to L2 gets approved (Provided F1 OPT is still valid). Once the COS gets approved, you need to stop working effective the "Valid From" date on the COS (That is the date on which your status changes to L2). After that, you can work only upon getting the L2 EAD.

            You can apply L2 COS and EAD together.

              Does that means I can apply for an EAD without waiting for an approved COS to L2. This will be great if I am allowed to apply for EAD and COS L2 together.
