L1A, division of the company is sold

  • L1A, division of the company is sold

    I'm holding an L1A visa. The parent company is selling the division which includes the India entity to which I belong to. My L1A is sponsored by the parent company. Once the sale is complete what will happen to my status?

    a. My current L1A becomes invalid and I have to return to my home country?
    b. My current L1A becomes invalid but the new company could help to apply a new L1 visa for me? Am I still qualified in this case?
    c. my current L1A is still valid even though the parent company I worked for has changed?

    Please let me know if the company that is acquiring the division needs to have any specific clause in the acquisition.

    It all depends on how the company is treating you.

    You can resign from your India entity & join your parent company to continue with your existing L1 visa.

      The L1A is only valid for an employee transferring between two related organizations. If the relationship between your US and Indian entities changes, your visa is no longer valid.

      Will your US employer have any other divisions in India? How long will the sale of the division take - can you apply for a Green Card before that sale is completed?

      In any case, this is beyond the scope of a forum. I strongly recommend that you contact your company HR and/or an immigration attorney.
