Can i apply L1B visa while on OPT or OPT STEM extension

Hello All,

I'm on my first year of opt and have already applied H1B this year, but i haven't heard anythings back from laywer yet,so, i assume that i'm not picked in lottery this year. I already started application of OPT STEM. Just want to know if i can transfer from OPT (F1 status) to L1B. I'm working in US headquarters now and my company has a some offices in Switzerland, Japan and Dubai which i don't work.

For any L visa you need to work for one year in last 3 years for the same company outside USA - if you quality for that, then yes you can switch.

Thank you, I'm working in my current company for almost one year. Of course, my company is in USA. My company will keep filing H1B for me next year if i'm not selected in the lottery this year which i'm still waiting the result. Is it ok for my company to send me to my home country working for one full year and come back to US? but my company doesn't have any affiliate or office in my conutry, but do have offices in Europe and Japan. Not sure if my company can register a company in my home country and send me back to work or send me to Europe to work a full year and then come back to US. Please advise. Thank you
