  • L1B blanket visa extension denial

    Hi,

My L1-b blanket visa extension is denied and I have to leave USA now. My employer says there is a cool off period of 1 year and I have to wait 365 days out side USA to reprocess a fresh L1. Can someone help me understand if this cool off period of 1 year is USCIS mandated ? And is it mandated only for L1-B. Can we do L1-A or L1-B Individual right away with out waiting for one year. Please let me know.

    Thanks in advance.
    Satya.

Its actually not a cool-off period per-say , but to apply for a fresh L1 once again you will need to work for the company (or its subsidiary) outside USA for an year in last 3 years. Since you were not outside USA for last 3 years - you do not qualify for a fresh L1.

    Hope this helps.
