  • Will an approved L2 visa affect L1 interview?

    Hi, My wife has L1B using which I had applied for L2 . I'm done with Biometric at VFS last week and the interview at consulate is coming up soon. Now my current employer has plans to process L1B for me in about a month. Assuming my L2 gets approved, when I go for L1 interview will my approved L2 affect the outcome?

    I tried to cancel my L2 appointment to avoid this situation, but since I'm done with Biometric, the ustraveldocs website isn't letting me to cancel the appointment and says -

    "You can only cancel appointments that are in the future and that are not associated with earlier appointments that have already been attended." Any idea how to get around this to cancel my appointment? Appreciate your help.

    Not a problem at all. Get your L2 stamped, then either fly to USA & file COS to your approved L1B or get L1B in your home country & then fly on L1B directly.

      Given that I haven't got L2 stamped and EAD is out of the scope now, if I travel to US on L2 then how can I file for COS? L1 requirement states that the employee should have worked for a minimum of 1 year with the employer or its subsidiary. If I have to travel to US on L2 it means I have to quit my current job with my employer here. When I'm in the US, how can I apply for COS when I'm not employed under the said employer? Just trying to understand if travelling on L2 and then applying for COS is a valid option.

        The requirement is that the applicant need to work for minimum 1 year out of last 3 years outside USA, with the same company or subsidiary.

        So you can still do that. Company need to file for your L1 petition (you can do premium) while you travel/settle in USA, once approved you can change your status from L2 to L1.
