    Hi,

    I had appeared for my L1 A interview in Chennai in Oct 2018 and my application was rejected saying i applied under the wrong Visa category. The gave me the blue slip in which the reason ticked was "Your blanket L-1 application is not clearly approvable under Section 8 CFR 214.2 (I)(ii)(B), (C) or (D), or INA 101 (a)(15)(L)"

    My lawyers recommended that i reapply under L1 B. I appeared for my L1 B interview in Chennai in Nov 2018 and again it was rejected. The reason was rejection was the same.

    The mistake my lawyers, company and i did was to not directly apply for L1 individual but to apply for L1B.

    Now my company and my lawyers have decided to apply to the USCIS for my L1 individual application in June 2019

    I have a few questions are they are as follows:
    - If by chance my application is rejected for the 3rd time, then does that mean i can never apply for a US visa even a tourist one? People have been advising me not to apply for the 3rd time and put my chances of ever going to the US at risk.
    - Do they look at past rejections while approving the L1 Individual application?
    - Have any of you'll had any such experience and what happened?
    - What are the chances that after USCIS approves, the embassy still rejects the visa?

    I'm really nervous about applying for the 3rd time. Any advice/ help/ guidance will be much appreciated.

    There is no such thing as 3 rejections leading to permanent visa ban. You can apply any number of times, as long as the rejection is not for things like fraud. Your past rejections are a part of your file. What weight to attach to them depends on your case. USCIS can always approve, and the consulate can reject your visa. There are no guarantees.
