L1B to L1A and to GC in EB1C Category

  • L1B to L1A and to GC in EB1C Category

    I am currently on my L1B and got extension approved for the remaining two years of tenure i.e., 07-01-2021 (July 1st 2021). I had verified with my employer and attorney for the upgrade/transfer options of my visa from L1B to L1A, I was told that I need to move out of US in order to do this for atleast one year of time and come back in a managerial/executive position.
    My assumption was I can transfer the visa status to L1A without moving out of US. I am on a role of Sr. Developer/Lead in India at the time of my L1B application and on the same position I was applied for L1B with a specialized knowledge in the product programming my company is selling.
    If I have to transfer to L1A then what is my next steps to talk to my company/attorney. My company is ready to give me an offer in a managerial position if it is some thing required here to do in US and to apply for L1A, but because of the attorney mentioned I need to move out of country my company didnt processed it last time during this transfer discussion.

    in order to. apply on L1A category, You need to be in a managerial/Executive position outside of US for the period of 1 year in the past 3 year. That is the reason your attorney asking you to move out of the country and spend one year on Managerial position.

      Wouldnt it be better for the company to just sponsor you for a Greencard vs going from l1b to l1a?

        Green card for L1B will go through EB2 route, which might take years to be approved.
