  • Question on L2 VISA Interview - Pl advice

    Hello, my wife went for a L1B visa interview on March 2nd 2010 and it got refused under 221g,Your blanket L-1 application is not approvable under Section 8 CFR 214.2(I)(ii)(D) and INA 101(a)(15)(L) "

    The reason that consular gave was her employer has filed a wrong type of visa

    she will be taking a long leave and come on a dependant L2 (I hold L1) and looking for a visa interview with in 2 weeks. Can somone please advise as what should she should answer if the consular asks her

    1) “Why your L1B was rejected”
    2) would you be working in US
    3) Why are you going on L2 - Should we give any specific reason
    4) In order to prove them that she will be back to India, she need to get a No objection certificate from HR stating that she is eligible to apply for leave and would be travelling to US. Her employer has granted her 3 months leave, if in NOC HR mentions as 3 months as her leave duration , will that affect her visa validity .

    >>> Well, your spouse is the best person to answer this. She need to be speaking the truth.

    2) would you be working in US
    >>> If she has no intentions of working on L2 EAD, then she can answer NO.

    3) Why are you going on L2 - Should we give any specific reason
    >>> What other visa can she apply? You are in L1, so obviously she will need to apply for L2. The VO would ask this question.
