  • L2 extension premium

    My company upgraded my L1A extension to premium after 4 months of no action..but
    my L2 case is still showing old status of case received..I have also applied for EAD extension where I got RFE of submitting approved L1A and L2 petition..by June30 ...if my premium L1A gets approved..but L2 still shows old status...how should I respond to the RFE..or withdraw the application ..kindly advice

    Since your L1 is on premium, you should get response within 15 days.

    Do not worry about the status shown online - at times it is not updated regularly.

      L1A , I will get response..what about L2 , there is no premium processing for L2 and EAD depends on L2..how will I respond to the RFE, if I only get L1A approved petition. After how many days /months L2 gets approved after L1?

        For L2, what you file is 539 which is extension of stay (i.e. I94). If that is so urgent, you can drive/fly to Canada/Mexico/Caribbean & get a renewed I94 (for L2) upon re-entering.

        Following that you can submit new I94 & approved L1 as response of RFE.

          Without approved L2 can I fly out of the country with only L1A petition and get L1 and L2 both stamped? If I only submit my L1A petition as an RFE response..will they reject...or is it advisable to withdraw the EAD?

            Yes, you can consult your attorney/HR as well. L2 extension is dependent on L1.

            Is your I94 expired ? or still valid ?

            If your L1 is approved, you can go out of country, get L1 & L2 stamped together (keep the L2 extension receipt handy) & return to USA.

                Yes, you can re-apply.

                Not sure how much time it is taking now-a-days - but consider it will be in months.
