Regarding L2 EAD

Hi,

I'm currently in L2 Visa and my spouse is in L1B visa. I had an EAD which expired in 2 months back.

My spouse's L1B petition expiry date(PED) is on Sept 2019. I thought of wait for the petition extension for my spouse's petition and then renew my EAD. Currently I'm not working but job search is in-progress.

My spouse's parent company suggested that L1B blanket petition validity is indefinite and legal to work in US until I94 expiry date. Does that mean, I can apply for an EAD renewal now? Since my spouse's PED is Sept 2019 in the document even though it is a blanket petition, is there a chance to get rejection/denial for my EAD renewal request? I've an I94 validity till mid of 2021.

Please share your suggestions.

This is contradicting. Even though the blanket petition based on which primary gets visa - there may be an PED mentioned in the visa. Primary cannot work past that date - you can certainly stay till your I94 expiry date.

L1B is right now going through high scrutiny & yes, there are chances for rejection/denial of extension.

PED on the visa is Sept 2019. But in I797 C receipt of my spouse blanket petition, the validity is mentioned as `Valid Indefinitely`. Could you please share your thoughts on which one we need to follow?

Blanket petition is for organization & can have indefinite validity. While your end date is the one mentioned in your visa as PED. You need to file renewal before your PED.
