  • Options for Extension of L1B visa ?

    Hi,

    Can someone help me with different options to get an extension of L1B visa.

    Currently, I am on L1B visa which will expire on 5th March 2020 and is due for extension on 5th Sep 2019(with in 6 months from expiry date).
    I am currently in US.

    My wife and I are expecting our first child by 28th Dec 2019 and she is in her 5th month of pregnancy.

    By the time my company's attorney prepares and files for my extension petition, it could be end of sep or beginning of oct. Considering the waiting time to get an appointment, it could be very late when we actually go for visa interview at a US consulate outside of US( preferably Canada). Also, It would be difficult for her to travel after delivery i.e. in Jan or may be Feb of 2020.

    I understand I can travel alone and get my L1B visa first at a US consulate outside US and my wife can go later for her L2 visa. But I am looking at a way where she could travel with me for her L2 visa. Be it end of Sep or first week of Oct at max, if possible somehow.
    Or is there a way she may not need to travel and get her L2 visa even while staying in US?

    Can somehow, I can apply for my L1B visa and her L2 visa with USCIS while staying in US itself?

    Also, is it possible to get an expedited Visa appointment for both of us showing the medical case of my wife?

    Would really really appreciate, if someone can help me on this.

    Well, you really do not need to leave USA to extend your petition & you do not need a new visa until you plan to leave USA & reenter.

    Remember, Visa is merely for entry purpose in USA, once you are in USA - you only need a valid petition & I94 (not visa).

      Libra_14 thanks a lot for your prompt response! I see you have been helping a lot of ppl out there and had expected you to definitely respond to my query That's so nice of you.

      With Visa query, I still didn't understand how can I stay back in USA after my visa expires on 5th march 2020. Somehow I need to extend my visa right? Are you saying my company file petition directly with USCIS just to extend my visa and I don't need to go outside at a US consulate?
