    Hi

    I currently have a L1 individual visa valid till June 2010, I will be traveling to India and will be coming back in May 2009 my questions are as following

    1. Is there any minimum visa valid period 60 days or more required to enter US, will there be any problems in POE?

    2. Once I come back and apply for L1 renewal, how long does it normally take to get the renewal?

    3. If my renewal take more time, beyond my original VISA expire date and the renewal is pending will I be allowed to work in US during the renewal is processing?

    4. If my renewal is denied, will I have to exist US immediately or will there be a time line to exit?

    1. Is there any minimum visa valid period 60 days or more required to enter US, will there be any problems in POE?
    >>> No. You can enter as long as the visa is valid. However, your will get an I-94 only till the expiry of the current visa/approval notice.

    2. Once I come back and apply for L1 renewal, how long does it normally take to get the renewal?
    >>> You will get a decision within 2-3 months by normal process and 15 days by premium.

    3. If my renewal take more time, beyond my original VISA expire date and the renewal is pending will I be allowed to work in US during the renewal is processing?
    >>> Yes.

    4. If my renewal is denied, will I have to exist US immediately or will there be a time line to exit?
    >>> Date on which your I-94 expired to the date until when you are in U.S will be considered as illegal stay. More the duration of illegal stay, the more trouble you will be in when you apply for future extensions or when you go for visa stampings. There is no grace period beyond I-94 expiry. If you the approval, then you are all good. If not, you will be in trouble.

      Thanks a lot shervin143 for your speedy reply I have a follow up question.

      Do I have to be in US for the company to file & process L1 extension or will I be able to apply when in am in India? I will be in on vacation but on US payroll during this time. The reason that I am worried is my visa is valid till end of June '10 and I will be coming back to US on 1st week of May '01 will there be sufficient time to complete the L1 renewal process.

        Usually travelling outside the country when the extension is in progress with USCIS might get the application denied or that you will get an extension as a consular processing. In which case, you will have to get the petition stamped.
