  • L1A extension and 240 days approaching

    Hi, I am on L1A visa and filled my extension for second time. It’s been 7 months and there was no response from USCIS even after raising service request. My case is upgraded to premium by employer. My questions are

    1. If there is RFE then I may have little time to respond and wait since I will be exhausting 240 days. Can I stay and wait for results after 240 days or need to leave the country.

    2. Will the stay past 240 days will be considered legal if result is not favorable ?

    When is ur I-94 Expiring ? Usually upgraded cases get the decision in about 15 Business Days.. if it goes to RFE.. and u crossed ur 240 Days from I-94 date . you cannot work.

    Also all the time u spend after 240 will be counted as Out of status I guess - pls correct me if im wrong.

      Sam Any updates on your case, did you stayed after 240 days r RFE, Same suitation for me recieved RFE

        With pending extension status, you cannot work beyond 240 days of your petition expiry. But you can certainly stay in USA with pending status.

        No, but it won't harm your history either - because you have legitimate reason for stay. However generally people leave the country to avoid any risk.

          Fortunately my case was approved and none of the above situation arose.
