  • Switching from L1 to H1B

    Hi,

Does anyone have experience of switching from L1 to H1B when already in the US?

    Situation:
Company A applied for L1 and company B for H1B. I wanted to work for company B but didn't know if petition would be selected in the lottery. Also L1 application process was extremely slow ( > 1.5 years)
L1 visa was approved and I moved to the US. Few months later I received a letter from company B that my petition was selected and eventually approved. H1B was not filed with changes of status request.
What are the ways to change status from L1 to H1B?

    Thanks

    (1) File a COS now
    or
    (2) Go to a consulate and get H1 stamped.

      Thank you scientist2016.

Do you know if it possible to file COS at any time or it should be done before 1st October?

Your employer will have to file for your H1B petition in April 2020 & then after approval, you'll need to file for COS from L1 to H1.

Why should employer file H1B petition again? It is already approved but was not filed with COS originally.
