Hi,
I stayed in USA on L1 for 4 years 1 month .(feb 2004 to aug 2008 excluding 4months outside usa stay)
I got a fresh H1 (approved for 3 years until sept 2011) , got it stamped in India and came to USA in nov 2008 (i94 issued till sept 2011).
Again, I went to India in nov 2009 for 15 days and back in USA. (i94 issued till sept 2011).
My total stay on H1 almost 1 year 5 months.
now, my total stay in USA both on L1/H1 is 5 years 6 months. Recently my PERM also got approved and planning to apply for I140 soon.
I know, as per law we can stay only 6 years.
my question is
what are the options I have when I complete six years stay(around sept 2010)? even though my h1 petition ,visa and i94 is valid till sept 2011 ?
#1 can i legally continue in USA since my i94 is issued still sept 2011?
#2 if not , should I be applying for h1 extension (assuming i140 gets approved before end of 6th year) ?
#3 or any other options/suggestions?
