  • L1 Extension & Visa Expiration

    Hi,

I was on L1 A visa in US and mine and family's Visa was expiring on 04/13/2010.

Due to some sudden death in my family I came to India last week and travelling back on 04/08/2010 with my family.

My company already filed my L1 extension before I came to India.

As there will be only 5 days left in My Visa expiration when I will be landing US, so please advise if there is any risk at port of entry.

    Your help is greatly appreciated.

    Thanks a lot.
    rmk.

If you travel outside the country when you extension is in progress with USCIS, then the extension of stay might get denied. In your case, you will get an I-94 only for 5 days. And later if the extension gets denied, then the period from which your I-94 expired to the date until when you are in U.S will be considered as illegal stay.

If you still decide to travel with just 5 days of petition validity, then at least carry the receipt notice of the filed extension.
Not a legal advice. Use of this information is strictly at your own risk.
