Having L1 & H1 visa - Go for L1 Extension

Hi,

I am working for Company A with L1B visa in US. I have applied H1B last year with other employer B. It was approved Oct 2009. But I havent receive any approval notice from Employer and not join company B. I am continuing L1b with Company A.

My L1B visa is expiring in next couple of weeks. So, My Company A is applying L1B extension for me. As per company policy, I should go to homecountry/ india for stamping.

My question :
If I go for L1B extension stamping to India,
1. will they consulates notify my h1b visa and ask any question on that
2. Is there any chance to get reject my L1 Extension due to my H1b
3, Will they send any RFC to company A to clarify my H1b

I am confused. Could you please help.

>>> No. Was your H1B approval a COS from your L1? If yes, then your employment with the L1 employer after the H1B approval is illegal (Unless your went out of the country and returned back on L1 again). If it is not a COS, then you are all good.

>>> See above answer. If H1B was not a COS, then there should be no issues. Otherwise you are out of status on H1B from Oct 1st and you have been on illegal employment.

Having 2 visa - L1 and H1 - Dummy Receipt Number

My case is bit confused. Please help.

I am working for L1 with Company A.

Company B offered me to file H1B last year 2009. I have received receipt number from Company B on May 2009. But, Till now, Status in USCIS website shows INITIAL REVIEW. Employer B said, they have received document, but not with them. They have been telling that trying get approval document from Attorney since Sep 2009. Till now, i havent received any approval notice from employer. And they are not even telling me whether it is filed with COS or counselor processing.

I dont know whether they have filed or not. Is It possible to get dummy/invalid Receipt Number. Why i am asking, there wont be any name displayed associated to number when we search by receipt number.

Company A is asking me to go for L1 Stamping to home country/india. In this situation, can i go for L1 stamping.

Please consider when you are answer question that I dont have any information from Employer B for H1B except that receipt number.

Q1 . In case employer B really filed my H1B with COS, but i didnt receive any approval notice, will my L1 extension get rejected?

Q2 . In case employer B really filed my H1B regardless of COS/Counselar processing/RFC, (but i didnt receive any approval notice), will my L1 extension get rejected?

Q3. Is it possible get invalid/dummy receipt number

Q4. Emp B is keep telling some meaningless reason whenever i request for approval documents. Based on that, what is your opinion. Are they file or not? Do we have any other way to verify emp B whether they filed or not except Approval Notice.

Q5. In order to check my documents, Do we have any way to communcate USICS via email or other Attorney.

I am afraid to go for Stamping without knowing this status. Please me.
