  • I-94 extension

    Hi,

I am on L2 as per the Visa status i got the Visa till Jun 2012, Issue is as my passport is getting expired on Jun 2010 i got I-94 till Jun 2010. Can you please help me out to understand the below queries.

    1) If i get the new passport how many days it will take me to get the New i-94 and what is the best process to get the I-94 extension.

    2) Is it mandatory to leave the country before the expiration of I-94 or do we have some days to stay in US even after expiration of i-94, If so how many days..

    Thanks
    Anil

    >>> You can try with the CBP. But the chances are very less. If that doesn't work, you will have to apply for the extension. Usually the approval takes2-3 months. So it is time for you to apply now if you decide to do that. If not, leave the country before your current I-94 expires and re-enter with the new passport and the approval notice. You will get a new extended I-94.

    >>> You need to leave the country before the I-94 expiry date or at least file for the extension. After the I-94 expiry, your stay will be considered illegal and it will cause issues later. There is no grace period.
