Can valid L2 visa holder (pending L2&EAD extension) travel to India and reenter US?

  • Can valid L2 visa holder (pending L2&EAD extension) travel to India and reenter US?

    I am currently on an L-1B visa, and my wife is on an L2 visa with an EAD (all expiring in Feb 2020)? My L-1B extension application has been approved until Feb 2022 under premium processing (pending stamping). My wife's L2 and EAD extension petitions are still in progress with biometrics just completed.

    Q1: Can my wife travel outside of US (India-home country) and re-enter US until a month before current L2 visa expiration (due to a family emergency)?
    Q2: Will traveling out of US and re-entering, impact her L2 extension or EAD extension petition? Will the applications become void?
    Q3: Is there any impact/any actions to be taken, if there is a change in her extension petitions, while she is outside of US?

    Certainly. Just give her copies of all of your documents (L1 visa, extension approval, latest payslips etc), to prove that she is an eligible L2 visa holder.

    Infact she doesn't need an extension, if she is going out of USA & re-entering. By re-entering she will automatically get her new I94 (which is same as your I-539 application).
    However she'll need to wait for her EAD extension application to be approved.
