  • Currently living in US with L1B - Looking for Green card help

    Hello All,

    I am currently working in the US on an L1B visa. My long term goal for myself and my spouse is to achieve green card status and settle down in the US.

    A few important pieces of information:

    1) I am a Canadian citizen.
    2) I currently work in Healthcare, and have a bachelors, and a masters degree in biotechnology.
    3) I have 8 years of professional work experience.
    4) My spouse is currently living in Canada.

    Question:

    1) If my current employer sponsors me for a green card would my spouse and i be able to apply on the same application, and resultantly receive our green cards at the same time?
    2) If not, how could my spouse benefit from my green card status?
    3) If not, would by spouse be able to renew her EAD after I receive my green card?

    It will be a different application for your spouse, but will be filed together & all further processing will go in parallel.

    If not, you can sponsor your spouse the very next day you get your GC.

      So can my spouse submit a separate green card application at the same time that my company submits mine, and it will be processed with mine regardless of whether she is residing and working in the USA?

      I believe if I sponsor her once I get my green card, it could take 5+ years for her to get her green card. Is this true? Can she work in the US in the mean time?

        I believe your will be EB2 category. In that case, first your employer will file for your immigration petition (I140), this has nothing to do with your spouse at this moment. Once that is approved, you & your spouse both need to file for AOS (I485), your wife need to be in USA at that time of filing.

        If she is not in USA at the time you file for your AOS (I485), then she you'll need to sponsor her & that process might take longer.
