  • L1A Extension Denied, How soon can I reapply?

    Hi! I could really use some guidance based on your varied experiences.

    Does the L1A “cool off” period of 1 year still hold if one is reapplying for L1A Visa, after facing a denial on an extension petition? Applicant has used up 3/7 years under L1A and has not worked outside of the US in the last 3 years.

    Secondly, does this impact GC process? I-140 has already been approved and we are waiting for our priority date under E1 category.

    Legally there is no cool off period, if you haven't used all of your 7 years on L1A.
    The rule says you worked for a foreign branch/subsidiary for 1 year before entering USA. However recently denied extension could be suspicious.

    No, If you filed for your I140, you are already in GC queue. You can continue to work in USA or outside with the same company.
