    Hi All

    I work in the UK for an american owned company. I am trying to get my L1-B visa to move across the USA. To bring knowledge of UK designed products to the USA which the USA currently does not have.
    We submitted for L1 application in september, premium processing.
    We then received a 10 page RFE.
    We responed to the 10 page RFE on 26th December.
    I have now just recieved a NOID from the USCIS. However it seems like they have not read or believe what we have submitted.

    We submitted proof of 1 year employment abroad as a HR letter with all positions and dates of employment as well as the last 6 years worth of P60 documents (uk version of a W2). Theyre response included. "Also appear to have been altered in an effort to conform to service requirements"

    As for speciailsed knowledge we submitted nearly 50 pages of evidence of knowledge and its seems like they did not read any of this. As theyre response questions in the NOID were answered in the previously submitted documentation.

    We are no trying to respond to the NOID to convince them. However i do not have much faith in this.

    Any thoughts or ideas on what we can do.

    Its not like they do not read your documents & blindly approve/reject the petitions.

    You need to understand that you are applying for an L1B visa - saying you've an specialized knowledge, which is rare & no one in USA is available to take that job.

    For example, one can write an pretty good text of 100 pages, with evidence to prove that he knows English language, but then is it really rare to find a person knowing English in USA? Answer is No.

    Better check, if you really qualify for L1B visa or not, or try to some other visa.

      Just had confirmation from USCIS that my visa was denied....Absolutely gutted as this has been such a long process and if had of been approved i would have been moving with my family in the next 4 to 6 weeks. Still awaiting to receive the letter with justification of denial. I would of thought an intercompany transfer would have been easier but i assume not.

        It is really easy, but USCIS is just protecting their own home (with unnecessary immigrants).

        So if you are really not a specialized skill person, they are just indirectly asking the companies to hire american & do not invite anyone from outside USA.
