  • L2 Visa and EAD Extension

    Dear All

    I had a question regarding L2 Visa and EAD Extension for my wife. Her L2 Visa along with mine is getting expired on 03-Aug-2020. The visa extension process will be taken care of by my employer. However, her L2 EAD is valid only until 26-Apr-2020. Should i go for L2 EAD Extension to get it extended at least till the visa expiry date of 03-Aug-2020, and then go for another extension after the visa is extended beyond August 2020?

    Any help in this regard will be very help as we are very confused right now.

    Yes, thats the only option you have to have her working maximum days.

      Dont think its worth applying to extend EAD as current time is good 5+ month in any center your application goes. We are in current situation where EAD has expired but cant do anything its taking 5-6 months. My only recommendation would be proactive and apply for your L1 as soon as allowed. L2 Visa and L2 EAD are taking very long these days.

            Thanks again. Would you know if there is a constraint around how many days before the EAD expiry can i file for my wife's EAD extension?

              Hello my L2 EAD would be expiring on 09/19/2020 and my current contract with my employer is getting over in July 2020. My husband's Organization is recommending his L1 A extension thru Mexico/Canada. Now to ensure continuity of my EAD, I would like to go for its extension in a way that I get it done before July. The questions I have are :
              - Can I go for a new job if my EAD extension is in "applied for status" . Does any of you have experience of shifting jobs when the EAD is about to expire on the basis of an extension being already filed
              - When I had received my EAD card in Nov 2018, there was a bar code also sent along with the letter. It mentioned that the bar code helps expedite the process of extension. Wanted to get an idea if that's something which genuinely helps to expedite the extension process.

              it would be great if I could be guided/suggested the best way out in my case.

                You are not allowed to work if your EAD is expired & your renewal is in process.

                Barcode is just to read the number using the scanner, instead of having someone type it.

                  No that doesn't help. And keep in mind that the current processing time is 5.5 to 7.5 months. So I would try to file for the EAD extension the latest, in March.

                    Hello,

                    My L2 Visa and my husband's L1A has a petition end date of 09/19/2020. My husbands organization typically applies for an extension for both primary and dependent in the last month [ September in our case ] . My husband's I-94 had a valid until date of 11/04/2022 and my I-94 is valid until 09/19 . I have an L2 EAD which too is expiring on 9/19. My husband's organization wouldnt file for an EAD extension for me. I assume that I cannot file for an EAD renewal until I've received an approved L1 and L2 extension. My husband has recently received an approved I-140. I wanted to know if this can help me file for an EAD extension for me. Currently EAD extension take 3-6 months to come thru and if my EAD is filed after we get our Visa extensions I would end up loosing my current job.

                    Also, is there a provision of me filing an EAD extension without an approved L1 and L2 Visa and later do a SR [ Service Request ] to substantiate approval of Visa.

                    Please kindly help with my query.

                      No, I140 doesn't give you any benefit for your current L2-EAD

                      No, you need to prove that the primary is maintaining an proper status at the time of applying for your EAD.
