  • L1B extenstion or to H1B convertion

    Hi
I reached US on 2008 November to work in L1B Visa with my employer. My l1B visa is getting expired on September 2010 end and the same day is the i-94 expiry date. I have now 2 options (given by my employer)
    1. Apply for an L1B extenstion.
    2. Proceed thru an H1B petition by my employer
I heard that lot of L1 extenstion requests are getting rejected now. Now its the end of May month 2010, which will be the best way to proceed?... Can anyone help in understanding more about this. Also what are the concerns in these. please let me know.

    Thnx a lot.

If you submit all the required documents, then the petition should get approved without any issues irrespective of whether it is L1 or H1B. The worst case is that USCIS will issue an RFE for more doucments and if you can provide them, then you are all good.

L1 has a total validaity onlyonly 5 years. L1 + H1B will get you 6 years. And ofcourse, H1B can be transferred to a different employer where L1 cannot.
