  • L1 A Individual RFE - Premium Processing - 2 Months over - Texas Service Center

    Hi,

    My Company filed for my L1A Individual through premium processing in the month of October 2019 through an attorney. The case was processed at the USCIS Texas Service Center. I got an RFE for my case on 24th October 2019 (Within 15 days as it is premium). Our attorney submitted the RFE response on 13 December 2019. They also shared the FedEx tracking number with me and when tracked the status shows as delivered in Texas.

    Ideally, since it is a premium processing, I should have got a response by 28 December 2019. But since 24, 25 and 31 December are holidays, I should have got my response by 1st or 2nd January 2020. Unfortunately, I did not receive any response. We waited for another week but still no response. That is when my attorney submitted a service request "Case is taking longer than the usual processing time".

    The service request was picked up by USCIS on 16th January 2020. On 17th January 2020, the status on USCIS changed to the below details:
    • On January 17, 2020, your inquiry about why your case is taking longer than our processing time, referral number SR1 YYYY YYYY XTSC, was completed.
    • On January 17, 2020, we sent a response to your inquiry about why your case is taking longer than our processing time, referral number SR1 YYYY YYYY ZZZTSC.

    My attorney received the response of the service request on 27th January 2020. The response to service request was below:

    "Please contact the TSC (Texas service Center) Premium Processing Unit in regards to your inquiry".

    My attorney have sent an email to the PPU as mentioned above on 28th January. It is 11 Feb 2020 and my attorney have not heard back from PPU yet.

    The USCIS website still shows status as "Request for Additional Evidence Was Sent". It has not changed to "Request for Additional Evidence Was Received" ever since RFE was submitted. I smell something fishy here. I am not sure what is going on.

    Anyone can shed some light on this would be really great. Yes, I have gone through similar threads where the response takes longer, but 2 months for premium processing seems unusual to me. Even after raising service request USCIS did not have an answer and they have asked to contact the PPU directly. Not sure what is going on.

    I guess they are saying to get your premium processing fee refunded - as they were not able to respond back with in 15 days.
