  • Moving back to home country after applying for L2 EAD

    Hello forum members,

    I have two specific questions:
    1. How soon can I apply for an L2 EAD (initial) once I land in the US ? I( believe once the I-94 gets updated ? How long does that typically take ?)
    2. When can I move out of the US after submitting my I-765 application (EAD) ? The information I got was: after the I-797C Notice of Action is issued. How long does that take?

You can apply the very same day you land in USA & admitted. I94 is allocated as soon as you clear the immigration process at Airport.

I797C will be issued as soon as your application reach USCIS & consider a week time for that paper to reach you back.

thanks ! Can you also let me know if it's okay to treat the e-notification that I receive upon inclusion of G-1145, E-Notification of Application/Petition Acceptance as a valid acknowledge of the Application and not explicitly wait untill i receive the paper copy ?

One can leave ASAP. One does not have to be in US to get the EAD. Have done this twice in the gap of 5 years.
