    Urgent Help Plzz !!!!!

    I am on L1b in USA since nov2009.i earned only $3350 for the month of nov & dec 2009.i have not filed any taxes till date.now i would like to bring my family to USA on a L2 .will it be a problem for me since i have not paid taxes in USA.my company takes care of all my living & they pay me $50 perDM.i get my pay thru cheque every month in USA.i have no W2 form from my employer.in this case what documents i need to submit to the consulate.
    What documents do i need from the employer to submit to the consulate..
    Plz help me ASAP.i am worried....

    Roopa,
    Your earning for 2009 was below the tax bracket and thus is not tax deducted. I think there should not be any worry regarding taxes and bringing your family to US.

      What is the annual salary mentioned in your LCA? If you are getting paid less than that, then you are in trouble.

        Hi Vamsy,

        This is my view. Others can help....

        Irespective what you earn/how much you earn - W2 needs to be given by the employer.
        Its not like that I am below the tax bracket then there should not be any W2.
        W2 is the legal document which tells how much you have earned/deductions etc.


        For second point - Check your LCA -what amount /annual salary is mentioned there ,and see that you have got that in pro-rated basis for two months.

        So , if your family goes for L2 visa stamping to the Consulate- then VO can ask for your 2009 W2,Pay Stubs.

          What Abhay has mentioned is absolutely correct. When you are in H1B or L1, you need to get paid according to LCA and your employer should provide you a W2 irrespective of whether it is below the tax bracket or not. Looks like they are treating you like you re in B1/B2.

            Actually,my company treats me as a consultant & not an employee.though i have been working for them since 13 years & i arrived in USA on a l1b visa.they pay me 50$ everyday perdm basis.
            so iget paid only 1500$ per month with all other facilities like medical insurance & accomodation provided by the company...
            i really do not know how to relate my earnings in USA.
            but it is clear in the L1B petition that it is 50$ per day with accomodation & medical insurance from the company...
            Plz help me.i am totally in doubt how to proceed further....

              If your LCA is approved for $50 a days (and if it is the same in your L1 petition), then you are all good. Just ask your employer to generate the W2. You will need to file the tax returns.
