  • L1A First extension denial and cooling off period

    Hello All,

    I used my L1A for 3 years and my first extension was denied, is there any cooling period for new L1 petition?

    I haven't heard of any cooling period and in my case, I was trying to get a fresh L1A which got denied, I immediately went for an L1B in a month which got approved. At that time I remember my attorney mentioned that there isn't a cooling period as I was worried as well.

      Since you've already spent 3 years in USA & then extension got denied, you should wait for an year to apply for fresh L1A.

      Because you were not in USA - his was extension & yours was fresh L1A - hence no cool off period for you.

          You apply for extension while staying in USA, consulate is for applying/reissuing visa.
