  • L1A (including recaptured days) expiring on May 22nd

    Hello,

    I need an urgent help.
I am on L1A visa. Both my VISA and petition are expiring on Jun 20th 2020. My L1A max out date (that includes recaptured days) is May 22nd, 2020. I have approved I-140, but cant file I-485 as dates are not current for Indian passport holder.
We were planning to move to Canada at the end of May. My Canadian work permit application has been filed but it got stuck due to Bio metrics requirement. I cant do provide my biometrics as all the centers are closed because of Covid19 pandemic. I am not sure when will the situation clears up and we will able to get the work permit to move to Canada.
Is there a possibility to extend my L1 status for few months due to this abnormal situation? If not, what other options do we have. India as other countries has closed borders and travel in this situation would not be safe.

I think you can extend your stay because of current situation. You'll need to file I539 (EOS) to extend your I94 - but can you work on that extension is doubtful. You may want to consult an attorney for that.

Thanks Libra_14. I will check with the attorney's about extending I-94. somebody suggested that I can also get a B1/B2 visa and stay here. Of course I will not be able to work. but it will give me more time for my Canadian work permit processing.
Vgupta4, this is my tentative plans. hoping that things open up in early may.

          Check this out https://www.uscis.gov/about-us/uscis-response-covid-19

USCIS has process based on i-129 extension of stay. Consult your attorney and as long as the filing is done on time pending the decision on extension you can continue your legal status upto 240 days.

Unfortunately my attorney says that since, I have already maxed out my L1A visa, this extension is not possible. as a matter of fact my L1A visa does not allow any more extension filing.

Sorry to hear that, but you can file for extension of stay & continue living in USA until this pandemic is over?

Does new executive order on immigration impact existing visa or extensions in process ?

Do you have some web link to share? my company attorney's are saying that neither extension nor COS to B1/B2 is a possibility.
